Legal Definitions

The term "Agreement" as referred to in this document shall mean the relationship established between an individual and Video Team, as defined within these Terms and Conditions, that occurs when an individual accesses any portion of any of the website(s) owned and operated by Video Team.

The term "Member" or "Membership", as referred to in this document shall mean the Subscriber or User of a valid username and password (User ID) for the Site during the term of Membership.

The term "Guest" as referred to in this document shall mean an individual who browses and views those portions of the Site that are free of charge to Non-Members. Guests are bound by the same Terms and Conditions as Members and Subscribers, except those Terms and Conditions which relate specifically to the exchange of payment for services. When a Guest receives his or her User ID, he or she is then considered a Member and Subscriber for the purposes of this Agreement.

The term "Site", as referred to in this document, shall mean the Site which as a Member you are viewing and to which you are purchasing a username and password (User ID) from Video Team in order to access that Site and its materials and benefits of Membership, or as a Guest the Site or portions thereof you are viewing located in the Non-Members or Guest sections which are free of charge.

The term "Subscriber", as referred to in this document shall mean the End-user or Consumer of the services of the Site and holder of a valid username and password (User ID) for the Site.

The term "User ID", as referred to in this document shall mean the combination of unique username and password that is sold by Video Team and used to access the Site. A User ID is a license to use the Site for a period of time which is specified.

The term "Bookmarking", as referred to in this document shall mean the act of placing a URL into a temporary file on the Subscribers' browser so that the Subscriber may return to that page at a future date directly.

1. Description of Services
Video Team will provide one User ID to access the Site and its contents for which you are purchasing Membership.

2. Billing
"VTEAM/AFROCENTR" or "DIGITALVIDEOTEAM" WILL APPEAR ON YOUR CREDIT CARD BILLING STATEMENT FOR ALL CHARGES MADE. SUBSCRIBER SPECIFICALLY UNDERSTANDS AND AGREES THAT THE ABSENCE OF THE SPECIFIC SITE NAME ON SUBSCRIBER'S STATEMENT IS FOR REASONS OF COURTESY AND PRIVACY AND DOES NOT ABSOLVE SUBSCRIBER FROM RESPONSIBILITY FOR PAYMENT OF CHARGES MADE.

3. Payment/Fee
The Site will have periodic subscription fees that are defined by the terms of the Site at the time of the initial enrollment for subscription. The Member is responsible for such fees according to the terms of the Site. The Site reserves the right to change the amount of the fees at its discretion upon notice to Member by e-mail or other means. ONCE A MEMBER HAS ACCESSED THE SITE USING THE USER ID ASSIGNED TO THE MEMBER, SUBSCRIPTION FEES BECOME NON-REFUNDABLE.

4. 30 Day Automatic Recurring Billing
SUBSCRIPTION FEES ARE BILLED IN 30 DAY BLOCKS OF TIME AT THE COST DESCRIBED ON THE SIGN-UP PAGE OF THE SITE. SUBSCRIPTION FEES WILL BE AUTOMATICALLY RE-BILLED EVERY 30 DAYS FROM THE DATE OF SIGN-UP FOR ANOTHER 30 DAY PERIOD AT THE IDENTICAL COST, UNLESS THE SUBSCRIBER NOTIFIES VIDEO TEAM OF HIS/HER DESIRE TO CANCEL THE MEMBERSHIP AT LEAST 24 HOURS PRIOR TO THE LAST DAY OF THE LAST 30 DAY BLOCK OF TIME BILLED. (Example: A Member signs up on March 15, and is billed his Membership Fee on March 15. On April 14 he will be billed again for another 30 days of uninterrupted service unless he has notified Video Team he wishes to cancel his Membership and has done so ON OR BEFORE April 13.) Unless and until this agreement is cancelled in accordance with the terms hereof Subscriber hereby authorizes Video Team to charge Subscriber's credit card or account number to pay for the ongoing cost of Membership. Subscriber hereby further authorizes Video Team to charge Subscriber's credit card or account number for any and all purchases of products, services and entertainment provided by the Site. The maximum Term of this agreement is 100 months.

5. Cancellation
Subscribers may cancel their Membership any time by electronic or conventional mail, by telephone or fax. The contact information for this purpose is provided at the end of this document. At any time, and without cause, subscription to the Service may be terminated at by either Video Team, the Site, or the Subscriber upon notification of the other by electronic or conventional mail or by telephone or fax. WHEN THE MEMBER REQUESTS TERMINATION OF HIS SUBSCRIPTION, FEES ARE NOT REFUNDED. SUBSCRIBERS ARE LIABLE FOR CHARGES INCURRED BY THEM UP TO AND INCLUDING THE DATE OF TERMINATION OF SERVICE.

6. Electronic Receipt
Subscribers may request a copy of the account of charges made for the use of the Site. Subscriber foregoes this right if such request is not made. Requests must be made directly to Video Team.

7. Refunds
Should a refund be issued by VideoTeam.com, all refunds will be credited to the credit card or account number used in the original transaction solely. Refunds will not be issued by cash or to another credit card.

8. Bookmarking
Subscriber agrees that at no time will he configure his computer and software to "bookmark" any page to the Site in such a way that would allow the Subscriber to bypass either the Terms and Conditions page or the Enter/Exit page of the Site upon subsequent entries to the Site. If such a bookmark exists, said bookmark and its use will constitute full agreement to all of the Terms and Conditions of the Site including admission that Subscriber is of legal age as determined by their state, country or region.

9. Authorization of Use
Subscribers to the Site are hereby authorized a single license to view, download, copy, or print material found on the Site. This license shall be granted for sole use via one computer. All Memberships are provided for personal use and shall not be used for any commercial purposes or by any commercial entities. Commercial use of either the Site or any material found within is strictly prohibited. No material within the Site may be transferred to any other person or entity, whether commercial or non-commercial. In addition, materials may not be modified or altered. Materials may not be displayed publicly, used for any rental, sale, or display. Materials shall extend to copyright, trademarks, or other proprietary notices therefrom. Video Team and the Site reserve the right to terminate this license at any time if the terms of this agreement are breached. In the case that the terms are breached, you will be required to immediately destroy any information or material printed, downloaded or otherwise copied from the Site.

10. Transfer of User ID
Access to the Site is through a combination of a username and a password (User ID). Subscribers may not under any circumstances release their User ID to any other person, and are required to keep their User ID strictly confidential. Video Team will not release passwords for any reason to anyone other than the Subscriber, except as may be specifically required by law or court order. Unauthorized access to the Site is a breach of this Agreement and a violation of law. SUBSCRIBERS ACKNOWLEDGE THAT THE WEBMASTER OF THE SITE MAY TRACK FRAUDULENT USAGE AND USERS THROUGH SPECIAL SOFTWARE AT HIS DISPOSAL AND THAT ANY AND ALL INFORMATION PERTAINING TO FRAUD MAY BE COMMUNICATED TO LAW ENFORCEMENT OR THE APPROPRIATE AUTHORITIES. If any breach of security, theft or loss of User ID or unauthorized disclosure of User ID occurs, SUBSCRIBER MUST IMMEDIATELY NOTIFY VIDEO TEAM OR THE SITE OF SAID SECURITY BREACH. SUBSCRIBER WILL REMAIN LIABLE FOR UNAUTHORIZED USE OF SERVICE UNTIL VIDEO TEAM OR THE SITE IS NOTIFIED OF THE SECURITY BREACH BY EMAIL OR TELEPHONE.

11. Sanction and Approval of Adult Material
This Site was designed to be used and viewed solely by people who are at least 18 years of age (21 in the states of AL, MS, NE, and WY) or who are legally considered an adult as determined by the community in which they live, who wish to access visual images, audio sounds, and verbal descriptions of a sexually oriented and frankly erotic nature. 13. Copyrights

Except as expressly stated in the Limited License provision in these Terms of Use, Video Team does not grant any express or implied right to you under any of his trademarks, service marks, copyrights or other proprietary information. You must obtain written or emailed permission from Video Team in order to establish a hypertext "link" to this site. A reciprocal link to your site is not guaranteed, and usually involves compensation.

24. Custodian of Records
All persons who appear in any visual depiction contained in the Site were eighteen years of age or older at the time of the creation of such depictions. The records required by Section 2257 of Title 18 of the United States Code with respect to visual depictions of actual sexually explicit conduct are kept by the custodian of records, C. S. Mann, who can be reached by email at christian@videoteam.com, and who has a business address of Video Team, 13401 Saticoy St.,North Hollywood, California 91605, except with regard to visual depictions of actual sexually explicit conduct made before July 3, 1995, which are exempt from the requirements set forth in 18 U.S.C. § 2257 and 28 C.F.R. 75.
